These Terms and Conditions govern your purchase of, access to, and use of the 14-Day Personal Operating System and any related materials, features, events, and community access made available under the Survive Live Thrive brand.
The 14-Day Personal Operating System is provided by MindWay Psychology Limited, a New Zealand company trading under the brand Survive Live Thrive. In these Terms, “we”, “us”, and “our” refer to MindWay Psychology Limited.
By purchasing, accessing, or using the course, you agree to these Terms. If you do not agree to these Terms, please do not purchase, access, or use the course.
2. Eligibility
You must be 18 years or older to purchase or use the course.
• By purchasing or using the course, you confirm that you are at least 18 years old, have the legal capacity to enter into this agreement, and that the information you provide to us is accurate and complete.
3. What the Course Includes
The 14-Day Personal Operating System is a digital educational course.
• Depending on the offer at the time of purchase, your purchase may include self-paced course videos, worksheets and templates, future course updates, a promotional free access period to a paid subscriber community, and live Q&A sessions or other live educational events during any included community access period.
The exact inclusions that apply to your purchase are those stated on the relevant sales page, checkout page, or offer page at the time of purchase.
We may update, improve, modify, replace, or remove parts of the course, community, materials, or features over time.
4. Educational Purpose Only
The course is provided for educational and informational purposes only.
It is not therapy, psychotherapy, counselling, psychology services, medical care, psychiatric care, crisis support, diagnosis, treatment, or individual clinical advice.
Your purchase of, access to, or participation in the course does not create a psychologist-client relationship, therapist-client relationship, healthcare-provider relationship, or any other professional treatment relationship between you and us.
Any live Q&A sessions, community discussions, or support provided in connection with the course are general educational interactions only and are not personalised psychological, medical, legal, financial, or other professional advice.
5. Suitability and Emergency Situations
The course may not be appropriate for everyone.
It is not intended for people in acute distress, crisis, or emergency situations, or for people who require individualised mental health care, medical treatment, or other professional support.
If you are in crisis, feel unsafe, believe you may harm yourself or others, or need urgent support, do not rely on this course. Seek immediate assistance from local emergency services or an appropriately qualified local professional.
You are responsible for deciding whether this course is suitable for you.
6. Pricing and Payment
The course is sold for a one-time purchase price in USD, unless otherwise clearly stated at checkout.
Payments may be processed through third-party providers such as Stripe and PayPal. Your use of those services may also be subject to their own terms and privacy policies.
You agree to provide current, complete, and accurate payment and billing information.
We may change prices, bonuses, features, or offers at any time before purchase. Any such change will not affect purchases already completed.
7. Refunds
We offer a 30-day, no-questions-asked refund for the course.
You may request a refund within 30 days of the date of purchase, even if you have already accessed the course materials.
To request a refund, email [email protected] within the 30-day refund period.
Unless otherwise required by law or expressly stated by us, the refund applies to the course purchase price only. Once a refund is issued, your access to the course and any included community access may be removed.
8. Access Period
When you purchase the course, you are granted access for as long as the course remains available.
This does not mean permanent or guaranteed lifetime access in all circumstances. Access continues only while the course continues to be offered and hosted by us or on our behalf.
We may suspend, discontinue, replace, retire, or materially change the course, platform, or associated materials at any time, acting reasonably.
9. Community Access and Subscription
Your course purchase may include a promotional free access period to a paid subscriber community, as stated on the relevant sales or checkout page at the time of purchase.
• Unless expressly stated otherwise, the free period does not automatically convert into a paid subscription; continued paid community access after the free period requires your active opt-in; and if you choose to join the paid community after the free period, the relevant pricing, billing cycle, and features will be disclosed before you subscribe.
• If you later become a paid community subscriber, you may cancel at any time before your next billing date and your access will continue until the end of the current paid billing period, unless your access is suspended or terminated under these Terms.
We may modify, suspend, or discontinue community features, live events, or membership benefits at any time.
10. Account Security
You are responsible for maintaining the confidentiality of your login details and for all activity that occurs under your account.
• You must not share your login details with any other person, allow multiple users to access the course through one account, impersonate another person, or access the course by unauthorised means.
You must notify us promptly if you become aware of any unauthorised use of your account.
11. Personal Use Licence
When you purchase the course, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable licence to access and use the course materials for your own personal, non-commercial use only.
You do not acquire ownership of the course or its materials.
Except where we explicitly make downloading or printing available for personal use, you must not copy, reproduce, modify, adapt, distribute, publish, sell, licence, share, teach from, commercially exploit, or create derivative works from any part of the course or its materials.
Where downloadable or printable materials are provided, you may use them only for your own personal use. You must not redistribute, upload, share, sell, or otherwise exploit them.
12. Intellectual Property
All content and materials made available in connection with the course, including videos, text, graphics, worksheets, templates, frameworks, names, branding, structure, educational content, live sessions, and community materials, are owned by us or licensed to us and are protected by intellectual property laws.
You may not use our intellectual property except as expressly permitted by these Terms or with our prior written permission.
13. Prohibited Conduct
• You must not share login credentials or account access; copy, reproduce, republish, or distribute course materials; resell or commercially exploit any part of the course; record live Q&A sessions, community calls, or other live events without written permission; scrape, harvest, or systematically extract course or community content; or upload our course content into AI tools or systems for reproduction, redistribution, resale, cloning, or other exploitation.
• You must not use the course or community in a way that is unlawful, abusive, defamatory, harassing, discriminatory, threatening, misleading, or invasive of another person’s rights; post confidential, private, or sensitive information about another person without proper authority; or present educational interactions in the course or community as if they were personalised professional advice.
14. Community Standards
If you participate in the community, comments, posts, or other interactive areas, you remain solely responsible for the content you post.
You agree not to post content that is unlawful, abusive, threatening, defamatory, hateful, discriminatory, harassing, misleading, deceptive, promotional spam, infringing, confidential, private, or otherwise inappropriate.
We may moderate, refuse, edit, restrict, or remove any post, comment, or other content, and may suspend or terminate access where we consider conduct or content to be inconsistent with these Terms.
We are not obliged to monitor all community activity, but we may do so.
15. No Guarantee of Results
We do not guarantee that you will achieve any particular personal, behavioural, professional, productivity, business, financial, or other result from purchasing or using the course.
Any examples, frameworks, case studies, illustrations, or discussions of outcomes are provided for educational purposes only and should not be understood as promises or guarantees.
Results vary depending on your circumstances, judgment, effort, implementation, background, environment, and factors outside our control.
16. Your Responsibility
You are responsible for your own decisions, actions, implementation, and results.
• You acknowledge that you are responsible for how you use the information in the course, should seek appropriately qualified local professional advice where needed, and should use your own judgment before acting on any information provided in the course or community.
17. Third-Party Platforms and Services
The course and community may be delivered or supported through third-party platforms, tools, or services, including Content Creator Machine, Stripe, PayPal, and other software, advertising, analytics, or hosting providers.
We are not responsible for outages, interruptions, policy changes, security failures, or service limitations caused by third-party providers, although we will act reasonably in selecting and using those providers.
Your use of third-party services may also be subject to their own terms and policies.
18. Suspension and Termination
We may suspend or terminate your access to the course, community, or related services immediately, with or without notice, if we reasonably believe that you have breached these Terms; shared account access; copied, misused, or misappropriated course content; engaged in abusive, unlawful, or inappropriate conduct; made a fraudulent payment or chargeback; or that your continued access may create legal, safety, reputational, or operational risk.
If your access is suspended or terminated because you breached these Terms, you may lose access without refund, to the extent permitted by law.
19. Service Availability
We aim to provide reliable access to the course and related services, but we do not guarantee uninterrupted, error-free, or always-available access.
From time to time, the course or community may be unavailable due to maintenance, technical issues, platform limitations, updates, security concerns, events outside our control, or discontinuation of services.
20. Limitation of Liability
To the maximum extent permitted by law, we exclude liability for any loss, damage, cost, or expense arising out of or in connection with your use of, inability to use, or reliance on the course, community, materials, live sessions, or related services.
To the maximum extent permitted by law, we are not liable for any indirect, consequential, special, incidental, punitive, or exemplary loss, including loss of profits, loss of revenue, loss of business opportunity, loss of data, loss of goodwill, or personal or professional disruption.
Nothing in these Terms excludes or limits any rights or remedies that cannot lawfully be excluded or limited.
21. Consumer Rights
Nothing in these Terms is intended to exclude, restrict, or modify any rights or remedies you may have under applicable consumer protection laws that cannot lawfully be excluded.
If you are located outside New Zealand, you may also have mandatory rights under the consumer laws of your country or region. These Terms are to be read subject to any such non-excludable rights.
22. Changes to These Terms
We may update these Terms from time to time.
The version published on our website at the time of your purchase will apply to that purchase unless a later version is required by law or expressly accepted by you.
If we make material changes affecting ongoing subscriptions or continued use of the community, we may notify users by email, platform notice, or website notice.
23. Governing Law and Jurisdiction
These Terms are governed by the laws of New Zealand.
You agree to submit to the non-exclusive jurisdiction of the courts of New Zealand, except to the extent that mandatory consumer laws in your place of residence give you the right to bring a claim elsewhere or require a different approach.
24. Severability
If any provision of these Terms is found to be invalid, unlawful, or unenforceable, that provision will be severed to the extent necessary, and the remainder of the Terms will continue in full force and effect.
25. Entire Agreement
These Terms, together with any policies or documents expressly incorporated by reference and any offer details presented to you at checkout, form the entire agreement between you and us in relation to the course.
